1. Introduction

BioRadar PBC ("BioRadar," "we," "us," or "our") operates the website at bioradarusa.com (the "Site"). This Privacy Policy explains what personal information we collect through the Site, how we use and share it, and the choices available to you.

2. Scope — Please Read

This Policy covers only personal information collected through the public Site — for example, when you subscribe to our briefing, contact us, or browse.

This Policy does not cover:

  1. Data processed under a separate agreement, including subscription agreements, data use agreements (DUAs), memoranda of understanding, or professional services contracts. That data is governed by the applicable agreement and by the privacy and security terms it sets out.
  2. Biosurveillance and public health data that BioRadar ingests, analyzes, or licenses as part of its intelligence products. This data concerns populations, pathogens, and environmental signals — not visitors to this Site — and any protected or limited health information is handled under the specific agreements and legal frameworks that apply to it, not under this Policy.

If you are a research participant, government partner, or customer covered by a separate agreement, refer to that agreement for how your information is handled.

3. Information We Collect

Information you provide. When you subscribe to the briefing, fill out a form, or contact us, we may collect your name, email address, organization, role, and the content of your message.

Information collected automatically. When you use the Site, our service providers and we may automatically collect technical and usage data, including IP address, device and browser type, operating system, referring pages, pages viewed, links clicked, and timestamps. Some of this is collected through cookies and similar technologies (see Section 6).

We do not intentionally collect sensitive personal information through the Site, and we ask that you not submit it through forms or messages.

4. How We Use Information

We use personal information to:

  1. Deliver the briefing and other content or services you request;
  2. Respond to your inquiries and communicate with you;
  3. Operate, maintain, secure, and improve the Site;
  4. Understand how the Site is used and measure engagement;
  5. Send you updates or marketing about BioRadar, where permitted (you may opt out at any time); and
  6. Comply with legal obligations and enforce our Terms of Use.

Where required by law, we rely on a lawful basis for processing, such as your consent, our legitimate interests in operating and improving the Site, or compliance with a legal obligation.

5. How We Share Information

We do not sell your personal information. We share it only as follows:

  1. Service providers. With vendors who perform services for us — such as hosting, analytics, and email delivery — under obligations to protect the information and use it only for the services they provide to us.
  2. Legal and safety. When we believe disclosure is required by law or legal process, or is necessary to protect the rights, safety, or property of BioRadar, our users, or the public.
  3. Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections.
  4. With your direction or consent. When you ask us to share it or otherwise consent.

6. Cookies and Similar Technologies

We use cookies and similar technologies to operate the Site, remember your preferences, and understand usage. You can control cookies through your browser settings; disabling some cookies may affect Site functionality. Where required by law, we will request consent before setting non-essential cookies.

We use third-party analytics providers, such as Matomo or Google Analytics, and an email service provider, such as Gmail, which process data on our behalf under their own terms.

7. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy, to comply with our legal obligations, resolve disputes, and enforce our agreements, after which we delete or de-identify it.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

9. Your Rights and Choices

Depending on where you live, you may have rights regarding your personal information, including the right to access, correct, delete, or port it, to opt out of certain processing, and to withdraw consent. To exercise these rights, contact us at support@bioradarusa.com. We will respond as required by applicable law and will not discriminate against you for exercising your rights.

California residents. Under the California Consumer Privacy Act, as amended, you may request access to, deletion of, and details about the personal information we collect, and you may opt out of any "sale" or "sharing" of personal information. We do not sell personal information. You may make a request at the contact below.

EEA/UK residents. If you are in the European Economic Area or the United Kingdom, you may have rights under the GDPR or UK GDPR, including the right to lodge a complaint with your local supervisory authority. Where we transfer personal information internationally, we use appropriate safeguards.

You can opt out of marketing emails at any time using the unsubscribe link in those messages.

10. Children's Privacy

The Site is not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, contact us, and we will delete it.

11. Do Not Track

Some browsers offer a "Do Not Track" signal. Because there is no common industry standard for responding to these signals, the Site does not currently respond to them.

12. Third-Party Sites

The Site may link to third-party websites and data sources. We are not responsible for their privacy practices. Review the privacy policy of any site you visit.

13. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date above and provide additional notice for material changes as required by law. Your continued use of the Site after changes take effect constitutes acceptance of the updated Policy.
